Examinations Under Oath

Examinations under oath [EUO] are unique to the insurance industry and are not just another deposition.  These are specialized formal proceedings where the insured is questioned by the insurer under oath and in the presence of a stenographer.  As an insured, you are most often contractually obligated to submit to this Examination, under the concept of simply confirming claim details.

 In reality, these examinations can be well-laid traps for the good-intentioned insured.  In addition to testimony, considerable document production is usually required.  An insured is often unrepresented and vulnerable throughout this process, which can be extensive in both time and content.   Policyholders claims are frequently denied after they submit to an EUO without legal representation well versed in the process.  The result may be different if you retain counsel to represent you in this legal process.
